That’s a question of “Administrative Law,” and it gets into the difference between a “rule” and an “order.” It’s hideously complicated legally, and it’s swampy politically.
Biden can’t wave a wand at a rule (as opposed to an order) and make it go away. Similarly, the EPA can’t wave a wand and make a rule. There has to be notice and an opportunity to comment by the public. That’s what the Federal Register is all about.
The article says they are “unveiling a rule.” I think it has to be nothing more than a proposed rule at this point.
